Mr. ABC s/o XYZ aged about 30 years residing at Malleshawaram, Bengaluru-560003 has received a summons in O. S. no 44/2022 from the XV^th City Civil Court, Bengaluru stating that he is the Defendant and the Plaintiff by name Mr. DEF s/o GHI has instituted the O.S.no 44/2022 seeking a declaration of title based on the sale deed dated 10-10-2020 executed by his brother, pursuant to the suit summons the defendant has filed Written Statement denying the case and submitted that there is a partition deed dated 8-10-2020 though which he became the owner and sought dismissed of the Suit. Draft a Verifying Affidavit on behalf of the Plaintiff.

I, Mr. DEF, S/o GHI, aged about 40 years, R/AT 6^th cross, Near , Bengaluru, Karnataka-560098.

I state that, I am the Plaintiff in the above suit, and I know the facts and circumstances of the case. Hence, I am competent to swear to this affidavit on my own behalf.
I submit that I have filed the present suit seeking a declaration of title for the suit schedule property based on the registered sale deed on 10.10.2020, which was executed by the Defendant’s brother in my favour.
The defendant has filed a written statement praying for the dismissal of the plaint and asserting that the suit schedule property is a joint family property based on a partition deed dated 08-10-2020, through which the Defendant claims ownership.
I submit that the defendant fraudulently caused the inclusion of the suit schedule property into the partition deed with the intent to unjustly benefit from the suit schedule property. I acquired the suit scheduled property lawfully and in accordance with the law.
I further submit that, the averments made in the accompanying plaint are all true and correct to the best of my knowledge, information, and belief.
I swear this affidavit in support of my plaint and to place the true and correct facts before this Hon’ble Court.
